It is a reality of business today that information technology products and methods are developing faster than the laws regulating them, and that the drafters of the laws could not have anticipated the advent of such technology and its new form of “property.” We have defended, prosecuted, and counseled in “Kodak”-type aftermarket claims arising from matters such as restrictions over software code and the licensing and distribution of software. We have prosecuted and counseled in cases where Walker Process and sham patent litigation claims were asserted as the basis for stripping patentees of immunity from antitrust laws.
Open source software, software licensing negotiations, and technology transfer all come with the potential for legal disputes for information technology producers, vendors, and users. And because information technology is integral to businesses in virtually every industrial sector, it is important to work with a law firm that has insight into and understanding of those different sectors as well as IT issues. We assist a wide variety of clients in the development and implementation of IT and outsourcing initiatives. We have negotiated business and strategic collaborations such as joint ventures, outsourcing deals, co-development arrangements, and manufacturing and distribution agreements. Our intellectual property counseling and patent practice enables our clients to leverage their intellectual property, defend against the claims of others, and establish a competitive position.
