Thompson Coburn partner Thad Blenke was quoted in an IAM article on Lenovo's patent dispute with Ericsson that could have broader industry implications.
Ericsson and Lenovo have been negotiating since 2021 without reaching a license agreement. The Office of Unfair Import Investigations (referred to as “ITC staff”) determined that Lenovo is technically willing to license but has reservations about the terms.
“The ITC staff believed Lenovo’s qualifiers created too much uncertainty as to when Lenovo would ultimately accept a UK decision,” said Thad. “Thus, the ITC staff recommended exclusionary action against Lenovo in the US since there was no assurance Lenovo would accept the first or any appealed UK global rate decision.”
