A Midsummer Update on USED Rulemaking Activity

As many in higher education are aware, the U.S. Department of Education is presently working to carry out a remarkably ambitious regulatory plan. The agency is deep into its efforts to delay, revise or rescind a range of complex regulations formulated by the prior administration, to include the controversial “State Authorization Rule,” the “Borrower Defense Rule” and the “Gainful Employment Rule.” In addition, the Department has proposed, or soon will propose, new rules impacting Title IX, accreditation, competency-based education and access to aid for faith-based institutions.  

On July 16, 2019, Aaron Lacey will provide an overview of the status and substance of Department's rulemaking activity as of July 2019, with a focus on developments that have, or could have, near-term impact for institutions of higher education. In particular, Aaron will highlight the newly effective reporting obligations under the borrower defense and state authorization rules, and the recent rescission of the gainful employment rule.
