Thompson Coburn partner Nathan Fonda was quoted in a roundup from IPWatchdog covering the decisions from 2023 that most affected the practice of intellectual property and will continue to play out in the courts into 2024.
In his reflection on milestones from the past year, Nathan noted the importance of a case related to litigation funding. “The IP Edge Delaware opinion referring parties and lawyers to the Department of Justice and the state bar cannot be overlooked as one of the key moments in 2023. That opinion is the clearest example of a trend, primarily out of the District of Delaware, of increased judicial scrutiny and skepticism about litigation funding arrangements in IP cases.”
