We represent public transit clients at every stage of the public procurement process. The firm’s attorneys have considerable experience developing procurement documents, such as instructions to bidders, requests for qualifications, requests for proposals, source selection plans, bid protest procedures, debarment procedures and general specifications, as well as providing counsel in the pre-award and change-order process.
Our representation includes developing and negotiating contracts for the operation and maintenance of transit services, as well as addressing changes, disputes and other issues that arise during contract implementation. Attorneys have worked on Brooks Act procurements, architectural and engineering contracts, facility construction, and construction contract administration and claims, including experience with standard form AIA contracts. This experience also includes contractual issues relating to liability, allocation of risk, indemnification, insurance, options, liquidated damages and incentives, performance and scope of work, capital equipment, workforce issues and compliance with applicable environmental statutes. Firm attorneys have significant experience working with the procurement guidelines for grantees issued by FTA, as well as other federal and state procurement requirements, including the Federal Acquisition Regulations (FAR). Our attorneys also represent clients in bid protests and litigation arising out of procurement disputes.
